What does this Privacy Policy cover?

We are eMcDermott, LLC (“SketchMaps”, “we”, or “us”). This Privacy Policy applies to the SketchMaps service, including all related websites, materials, livestreams, presentations, and other content (we’ll refer to this as the “Service”).

By using the Service, you agree to the terms of this Privacy Policy. Please read our Terms of Use as well, for general guidance about your use of the Service. Except as otherwise expressly agreed, this Privacy Policy and our Terms of Use are the complete agreement between you and SketchMaps.

What Information Do We Collect?

We collect and process different types of personal data depending on how you interact with our Service. Here’s an overview of the information we collect:

Contact Information

When you interact with us, such as when you participate in contests, surveys, or promotional events, and livestreams and other presentations, you provide feedback or report issues, you request or receive customer or technical support, and you sign up for communications, including newsletters, updates, and promotions, we collect certain contact information you provide us, such as your email address and name.

Account and Profile Information

When you create or update an account with us, we collect certain information to manage your account, including your username, email address, password (hashed), account preferences, and profile picture/avatar (if available).

We use this information to create and manage your user account, access your selected/purchased items and portions of the Service, enable account features (recovery, personalization, preferences), enforce Service rules and security measures, and track and fulfill purchases.

Service Usage Information

As you use our Service, we automatically collect information about your interactions, including your content interaction history, login times and frequency, subscription status, and user preferences.

We use this information to manage user preferences and settings and provide the Service’s core functionality.

Device and Behavior Information

We automatically collect certain technical and analytic information from you and your device when you use our Service, including your device specifications (device type, model, OS, browser), performance metrics (crashes, errors, load times), and usage patterns (features accessed, time spent, navigation).

Please note that we do not store complete payment card information – this is handled by our secure payment processors.

We use this information to enable user-to-user interaction, interactions between you and the Service, public display of Service content, and to maintain and enforce community standards.

How Do We Share Your Information?

  • Technical Service Providers: We may share certain personal data with trusted service providers who help us operate and improve our Service, to analyze how our services are used, host our services and store your data securely, monitor service performance and errors, prevent spam and abuse, and process and route email communications.
  • Business Partners: We work with certain business partners and service providers to assist with providing the Service to our users, such as to enable cross-promotions, manage licensing agreements, and provide premium content to users.
  • Payment Processors: We share data with our third-party payment processors partners to manage subscriptions, prevent fraudulent transactions, process payments and transactions, and process refunds.
  • Social Platforms: When you utilize social functionality of the Service, we share data with social networks and other third parties to enable content sharing and enable social features.
  • Service Users: When you provide content and contributions to the Service publicly, such as when participating in a livestream presentation or engaging in social features on the Service, your contributions may be made public to other users of the Service and the public at large, including your questions, comments, suggestions, personal appearances, and other contributions.

How long do we keep your data?

We only keep your personal data as long as it’s required to provide you with the Service. Sometimes a longer period might be required by law. 

After that, we will delete your personal data within a reasonable time.

Please note that we may retain some data, if necessary to: 

  • resolve disputes, 
  • enforce our user agreements, 
  • follow any technical and legal requirements related to the Service.

Children’s privacy rights

We don’t knowingly collect any personal data from children under the age of 13. We also don’t knowingly allow them to create accounts, sign up for newsletters, make purchases, or use the Service. 

We may also limit our personal data processing for EU users between 13 and 16.

“Do Not Track” Signals: Because there’s not yet a consensus on how companies should respond to web browser-based or other “do not track” mechanisms yet, we do not respond to web browser-based do not track signals.

EU and UK Residents:

We are regulated under the General Data Protection Regulation (GDPR), which applies across the European Union. We are responsible as a controller of personal data for GDPR purposes.

Legal Basis for processing your personal data:

In accordance with the General Data Protection Regulation (GDPR) and UK data protection law, we process your personal data based on the following legal grounds:

  • Contractual Obligations. We process specific sets of your data to fulfill our contractual obligations to you. This encompasses actions like account creation, operating financial aspects of the Service, providing Service communications functionality, and general Service operations and delivery.

California Resident Rights

International Data Transfers

Our headquarters is in the United States. 

No matter where you live, by using the Service you consent to the processing and transfer of your personal data in and to the United States. This processing will also be under the privacy policies of third parties that we share personal data with.

Security Measures

We have taken steps and put security measures in place to prevent the accidental loss or misuse of personal data. 

For example, we limit access to those who have a genuine business need. Those processing your information will do so only in an authorized manner.

We may make further updates from time to time, which will be reflected in the latest version posted on the Service. For major changes, if we have your email address or an account on file, we will inform you via email or through your Account. Otherwise, we will post a message on the Service about the change.
